    This may end up setting some precedent depending on the outcome. No doubt that whatever is on those tapes could really hurt Merlino and the other defendants. The question is will the jurors find Rubeo a despicable enough character. That probably isn’t much of a stretch especially with whatever nonsense he tried to pull with his attempted self editing audio job. Also will they be fed up enough with the FBI’s questionable behavior in handling that situation as well. You just never know which way a jury is going to react to those issues. It’s all well and fine for a Judge to instruct jurors to disregard certain things or what they can and cannot consider during deliberation but at the end of the day the jurors are still human and frankly will consider whatever they want. They could definitely cut Merlino a break simply because he may come across slightly less despicable then Rubeo and the Feds. Weather it’s proper or not sometimes people simply go for who they like better despite the evidence. This case just seems like a total Crap Shoot!

    The question is, if Joseph Merlino beats this case, will he consider it a stroke of good luck and retreat to the shadows or will he behave like John Gotti believing he’s untouchable.

      I would def lean more to the Gotti part of that answer. Just seems to be how he is he doesn’t know or want to know about how to duck and to stay outta the way.
